What is a municipal drain?
- Ditches or closed systems such as pipes or tiles buried in the ground

What is the purpose of municipal drains?
- Improve the drainage of agricultural land
- Remove excess water collected by roadside ditches
Why is it called a “Municipal drain”?

When is a Mutual Agreement Drain made?
Two or more owners enter into a written agreement to construct or improve a drain on their land.
When an owner is unable to get sufficient signatures for a petition, what kind of Drain might be created and how?
- Requesition Drain
- May file a requisition with the Clerk requesting that an Engineer be appointed for the work
What is the condition that must be met for a Petition Drain?
The majority of owners or owners of 60% of the land needing to be drained submit a petition to a municipality requesting assistance.
What may happen after a petition is circulated and presented to council?
- Council considers the petition and within 30 days, sends copies of its decision to the petitioner
> Denial: Any petitioner can appeal the decision to a tribunal
> Accepted: Council must appoint an engineer
After a petition is accepted and an appointed engineer submits files with the Clerk, what can happen?
The Council may or may not pass a resolution to proceed.
