What is the offence
It is an offence for someone to fail to remove and dispose of dog excrement without reasonable excuse or consent from the land owner or occupier
What’s the second offence
It is also an offence for someone suspected of an offence to fail to give their name and address to an authorised local authority officer
Where does the act apply
The act applies to all public places including any common passage, close, court, stairs back green or similar areas
Is there a need for corroborative evidence
The act removes any need for corroborative evidence in any subsequent proceedings
Who can issue an FPN
Local authority officers and police can issue FPNs as an alternative to criminal proceedings.
How long do they have to pay it
28 days to pay or challenge it
How much is the FPN
£40 rising to £60 if not paid within the time unless a hearing or the ticket has been withdrawn
Who is exempt form this
Guide dog
Dogs driving or tending to sheep or cattle
Dog on official duties - police armed forces or customs
Dog being used for emergency or rescue
Dog aiding a disabled person
