what is restorative justice?
SYSTEM for dealing with criminal behaviour focusing on REHABILITATION of offenders through RECONCILING with victims.
This enables offender to see the IMPACT of their crime and EMPOWERS victims by giving them a VOICE.
How does restorative justice CHANGE the emphasis?
Because it focuses on the needs of the VICTIM rather than the STATE (enforcing laws/punishment.) So the victims play an ACTIVE role in the process and offenders take RESPONS for their actions.
Focuses on victims and offenders recovery and rehabilitation in general.
what are the KEY features of the process?
*TRAINED mediator supervises the meeting.
*NON-courtroom settings where offenders meet VOLUNTARILY with survivor.
*Survivor EXPLAINS how the incident made them FEEL so offender can understand the CONSEQUENCES of their actions and DISTRESS caused.
*focus on POSITIVE outcomes for both SURVIVORS/OFFENDERS
when does restorative justice occur/effect sentencing?
Restorative justice may occur PRE-trial, ALONG side a prison sentence or as an ALTERNATIVE to prison or INCENTIVE to reduce the length of prison a sentence.
what does restitution look like?
Restitution may be FINANCIAL to cover repairs for damage, psych or physical harm.
*EMOTIONAL restitution where offender SUPPORTS V’s HEALING by rebuilding CONFIDENCE.
Who are the restorative justice council?
Body who ESTABLISH standards for the RJC whilst SUPPORTING victims and professionals in the field.
Also ADVOCATES for restorative practise in SCHOOLS, preventing and managing conflict.
