Please explain the Traditional Divorce Law.

A

Law permitted divorce only if:

Spouse committed misconduction such as:

  1. Adultery
  2. Cruelty
  3. Desertion (Verlassen, Fahnenflucht)

Child custody was intended to reward the innocent and punish the guilty.

A

No Fault Law: Do not assign blame and allow divorce on the basis of “irreconcilable differences” or “Marital Breakdown”.

This law is have been proved to be harmful to wives and children.

According to today’s divorce law property is divided. Explain how and how was it with traditonal law?

A

Property is shared in half. A woman shares her half in most cases with her children. Home is sold and the money is shared usually.

Tradionional Law says that: The innocent party remained in the matrimonial home with children.

A

Disturbs the normal functions of a family:

  1. Values are questioned
  2. Trust is lost
  3. Respect diminishes
  4. Financial difficulties

  2. More pressure of responsibilty on the custodial parent

  4. Child care
  5. House maintenance
