Defined under S8 of the theft act 1968 as the use of force on any person or putting or seeking to put any person in fear during the act of theft.
What is the actus rea for Robbery?
Using force or putting or setting to put a person in fear during the act of theft. (Alongside the AR for Theft).
What is the mens reas for Robbery?
The intent or recklessness to use the threat of force (Alongside the mens reas for theft).
What is an example case for Robbery?
R v Hale 1979 - where tying up the victim allowed the successful completion of theft
R v Dawson and James 1976 -The fact that the victim was not afraid did not mean that the defendant did not attempt to out him in fear.
