When is it enforced?
When an organisation owed and failed a duty of care to the deceased person.
The way in which the organisation’s activities were managed or organised:
Caused the death or
Amounted to a gross breach of the duty of care.
What are the consequences?
Senior management are the target. With the possibility of life imprisonment for any director or similar found guilty of negligence.
The Firm will face a severe fine.
The Firm may have a ‘publicity order’ to tell the world.
What are the tests?
The organisation or its agents must be grossly negligent, substantially to blame and that failure has caused someone’s death.
