What does Section 35 of the Constitution Act tell us, and how did this mostly affect Metis people?
Section 35 = Aboriginal people of Canada are the Indians, Inuit, and Metis.
- Metis people remained undefined in the Constitution until 2015, were a provincial responsibility rather than a federal responsibility.
Differentiate between Status, Non-Status, and Treaty Indians:
Status Indian:
- A person registered under the Indian Act, whom the laws of the Indian Act apply to.
Non-Status Indian:
- A person whose ancestors were never registered or who lost their status later through other means, and therefore are legally the same as any other Canadian.
- Defined Indianness to maleness, an Indian woman that married a non-status Indian men lost her status and was no longer considered Indian.
Treaty Indian:
- Signed one of the numbered treaties (1-11) in the late 19th century and early 20th century.
- All Treaty Indians are Status, but not all Status Indians are Treaty.
What are some unique First Nation stats since 2021?
First time in Canadian history that the FN population has exceeded over 1 million.
- FN’s make up over half of the FNMI population.
- Half of the FN population live OFF reserve. Most live in Western Canada.
- Ontario has the largest amount of FN’s, nearly 1/4 of the FN population in Canada.
- More non-status FN living in urban areas compared to status FN’s.
What are some unique Metis stats since 2021?
- Metis are just over a 1/3 of total FNMI population.
- Most live in Ontario and Alberta.
- Majority of Metis live in cities.
What are some unique Inuit stats since 2021?
- Majority of Inuit live in Inuit Nunangut (different areas in the territories).
- Lowest number of the FNMI population (4%).
Majority of Inuit in Canada reported they were enrolled under/a beneficiary of an Inuit land claims agreement. - Not many live in cities.
