What are 6 sexual violence myths?

A

False Reports:
• “People are lying or exaggerating when they talk about experiencing sexual violence.”

Victim blaming:
• “If they’re dressing “that” way then they’re kind of asking for it.”
• “Why did they go to that guy’s house anyway?”

Suspicion of ulterior motives:
• “Survivors are only looking for attention/status/ money, or are acting out of regret.”

Minimizing:
• “People nowadays are too sensitive/overly politically correct/
anything can be construed as sexual violence.”

Absolutizing:
• “So, basically, you’re saying anyone who’s had sex while they were drunk has actually raped someone.”

Benefit of the doubt to perpetrators:
• “He’s such a nice guy”
• “Different countries have different understanding so they didn’t know”

What is consent?

A

Under the Canadian Criminal Code consent is defined as “a voluntary agreement of the complainant to engage in the sexual activity in question.” (Section 273.1)

Consent is not valid if…?

A

The criminal code further outlines five specific situations in which consent is not valid.

Consent is not valid if:

• It is given by someone else;
• The person is** incapable of consenting** (i.e. unconscious, sleeping, drunk, or stoned);
• It is an abuse of power, trust, or authority;
• The person does not say yes, says no, or through words or behaviour implies no;
• The person *changes their mind.

What are the 3 exceptions?

A

16 years old

● 12-13 - You can consent with someone less than 2 years older than you
● 14-15 - You can consent with someone less than 5 years older than you
● 18 - It is not legal for someone over 18 to have contact with someone under 18 when there is a relationship of authority, trust or dependency
