The Commerce Clause
authorizes Congress to regulate foreign and interstate commerce; US has free trade zone between all states; president and Congress, not states, have the power to negotiate treaties with foreign markets
Appropriations
Article 1, section 9, clause 7 gives Congress authorization of federal funds to specific federal departments/ agencies or programs
The Necessary and Proper Clause
gives Congress the power to make all laws that are “necessary and proper” for carrying out its duties, extending its powers beyond the 17 clauses
The War Powers Clause
Congress has the power to declare war, not the President; “ grant letters of marque and reprisal”: seizing of enemy ships on sea
Confirmations
appointments clause: the Senate must approve by majority vote all presidential appointments to office; cabinet positions, agencies, diplomatic/ military posts, federal court judges, supreme court justice nominees
