Identify the steps to terminate a contract for default

A

KO: Get appropriate legal counsel and consider other alternatives to a T4D.
KO: Document the reasons for considering a T4D.
KO: Issue a cure or show cause notice/letter.
KO: Issue a notice of termination.
KO: Inform affected parties to the T4D, ie customer.
KO or TCO: Conference with the contractor about the T4D process.
KO: Amend or rescind the termination notice of appropriate.
TCO or KO: Protect any inventory and negotiate payments for that inventory or issue decision.
TCO or KO: Determine the amount owed the contractor if any.
KO: Re procure the remaining requirement if any.
KO: Demand payment from the contractor if any owed the Government.
KO: Document the file.

A

Things change and change fast !

New weapon systems, military strategic planning, funding, relocating of vital materials, natural disasters.

To use the term “flexible” and the Government in the same context is a stretch, BUT, the Government has got to have the ability to legally respond to changing needs.
