What makes an offence a summary offence?

A

No imprisonment or less than 2 years imprisonment.
Property damage or theft less than $2500 or less

What is a minor indictable offence?

A

An offence more than 2 years but less than 5 years imprisonment.
Or
Imprisonment greater than 5 years AND
-Property damage more than $2500 less than $30000.
-Theft/Deception offences more than $2500 less than $30000.
-recklessly cause harm to another
-indecent Assault - victim 14+ years
- basic non-aggravated SCT $30000 or less (SCT = serious criminal trespass)

When must you give the Police caution

A

You must caution for every offence. If interviewing for 50 offences caution must be given 50 times.
