A

must be established agricultural unit on 24th July 2023
Where the site became part of established agricultural unit after 24th July 2023 must be a period of atleast 10 years uner classs Q
Any floor space must not exceed 150 sqm
Maximum of 10 dwellings
Must not exceed 1000 sqm
No Agricultural tenancy
Must not form part of: SSSI, safety hazard, militry explosive, must not be a listed bulding

what are the two tests for rural dwellings

A

fucntional test- must prove eitehr 2,200 hours per year or 275 standard man days of eight hours per year

Financial test- three years of audited accounts and a year or two forecasts
Must be approximately £20,000 profit a year

How to get rid of agricultural tie

A

Proof that the non-qualfying tenant for longer tahn 10 years and then apply for CLEUD (certificate of lawfulnes of existing use or development or prove there is no requirement or need for a qualifying tenant. Must market the property of 12 months wiht 30% reduction reflecting the Ag tie. If after 12 months there has been no interest then is forms part of section 73 to apply to council to remove consent
