What does the Consumer Contracts Regulations 2013 cover?
It states customers rights when shopping online
What rights does the consumer have under the Consumer Contracts Regulations 2013?
Orders can be cancelled and a full refund given up to 14 days after the product is received
They cannot cancel their order if the product was a digital download
What information does the Consumer Contracts Regulations 2013 require the trader have to provide?
Traders must provide:
- a full description of products
- product prices
- delivery charges
- methods of payment
- information on returns
What does the Data Protection Act 1998 cover?
The DPA controls how personal data can be used by organisations
What are the 8 principles of the Data Protection Act?
- Data should be processed legally and fairly with the consent of the data subject
- Data must only be used for the specified purpose
- Data must be relevant for the intended purpose
- Data must be kept up-to-date
- Data must not be kept for longer than necessary
- Data must be processed in accordance with the rights of the data subject
- Data must be held safely and securely
- Data must not be transferred outside the EU
What is a data subject?
The person whose data is stored
What is a data controller?
The person who is responsible for making sure an organisation complies with the Data Protection Act
Who is the Information Commissioner?
The government agent who is responsible for enforcing the Data Protection Act
What does the Computer Misuse Act 1990 cover?
It protects users against unauthorised access to computer systems
What are the three offences created by the Computer Misuse Act 1990?
Gaining unauthorised access to a computer
Unauthorised access to a computer with the intention of committing a further crime (e.g. fraud, data theft)
Unauthorised modification of data
What does the Copyright, Designs and Patents Act cover?
It protects the intellectual property of people who create and produce material based on original ideas.
This can be music, written, video, games or any other original material.
Users must purchase a software licence for each piece of software they use.
