How do police ensure compliance with the Arms Act 1983?
Police will focus and tailor interventions in line with:
- the levels of RISK
- the ACTUAL or POTENTIAL consequences
- the behaviour / attitude / capability of firearms licence holders.
What are the 2 aspects of risk Police focus on?
- the magnitude of the consequences that may eventuate (should an event occur)
- the likelihood of that event occurring
How do police expect firearms licence holders to operate?
Safely
Securely
Responsibly
What does Compliance mean?
“MEETING or EXCEEDING the requirements of the regulatory framework.
It is designed to ensure PERSONAL and PUBLIC safety,
SECURITY of,
and RESPONSIBLE use of firearms”
Police seek the highest level of VOLUNTARY compliance
Are police decisions in regards to compliance uniform?
No.
Police aim to be consistent in their decision-making
However, this DOES NOT mean uniformity of decision making.
Each case is unique.
Police response must be applicable to the facts of the particular event.
What is the aim of Police compliance activities?
Activities are aimed at having the MAXIMUM impact on outcomes
- Personal & public safety
- security of
- responsible use of firearms
What is the priority?
The priority is on achieving these outcomes - (personal & public safety, security of, responsible use)
RATHER than commencing enforcement action for every technical breach
Who determines the appropriate intervention(s)?
Police will determine the appropriate intervention
Based on consideration of
Risk
Attitude
Behaviour
Capability
What will police interventions take into account?
- logical, timely, considered
- evidence based
- made impartially
- robust enough to withstand judicial review
- proportionate to the risk (posed by non-compliant behaviour)
- consistent with the law / public interest / police polices / values
