What is a fleeing driver?
A driver who has been signalled to stop by a Constable
But fails to stop or remain stopped
Or a driver who flies as a result of Police presence
Whether signalled to stop or not.
What is the paramount consideration in a flaring driver situation?
Safety
What will be reviewed after each fleeing driver event?
Whether the decision was?
- appropriate
- lawful
- justified - considering the circumstances
- compliant with Police Instructions
And
- whether there are lessons to be learnt and applied.
What is the overriding principal when applying TENR to a fleeing driver incident?
“Safety is success”
What must be balanced in the TENR risk assessment of a fleeing driver incident?
- initial threat posed by the vehicle occupant(s)
- necessity to immediately apprehend the driver and/or passenger(s)
- risk of harm to any person if the driver fails to stop or remain stopped
What should always be considered?
Consideration should always be given to delaying the signal to stop
While coordinating tactical options
And/or
Waiting for the wider environment to become safer
And the risk reduced
What is the hierarchy of identification when identifying a body?
1) visual ID
2) Fingerprints
3) Odontology
4) Comparison Identification Process
5) DNA
Visual ID
If visually identifiable
And
There is an appropriate person to complete
At the time of ID - consider attaching a photo of deceased to Statement of ID
(to illustrate appearance of deceased)
Fingerprint ID
Check NIA for AFIS -
Contact local SOCO to complete
Request authorisation from the coroner
Odontology
Forensic evaluation of dental evidence
Request authorisation from coroner
Comparison Identification process
Contact duty SAR
-to engage DVI staff
And
advice about the completion of a Comparison Report for the Coroner
DNA
Request authorisation from Coroner
Is visual ID sufficient?
Yes - usually.
However - if the person does not look in death like they did in life - visual ID is not appropriate
Non-visual ID methods are required.
Who is responsible for obtaining sufficient evidence of Identification?
Police
Release of body
The coroner cannot release the body until satisfied with the identification of the deceased.
What is the process when visual identification cannot be established?
Consult with District DVI team
who are trained in comparison identification procedures.
Keep duty coroner informed of steps you are taking to ID the deceased.
Do this through NIIO.
What is the NIIO?
National Initial Investigation office
What is the process when media approach Police for comment in the aftermath of a sudden death?
Seek advice from the Police Media Team
Consult with the Responsible Coroner -
in cases when Police WISH to make comment in relation to an ACTIVE coronial investigation
What is important for Police to recognise in relation to talking to media about sudden death(s)?
Important for Police to recognise the restrictions on discussing matters before a coroner
Who is responsible for determine the circumstances of a death?
It is the coroners role to determine circumstances of death
THEREFORE it is not appropriate for police to make premature comment to the media.
What happens when a coroner determines there is NO need for a Post-Mortem?
Coroner can authorise release of the body back to whanau
Does a coroner have legislative authority to determine the need for a post-Mortem?
Yes.
One of the Coroners roles is to determine the cause of death.
They have the legislative authority to determine the need for a post-mortem
To assist them determine the cause of death.
