What are unilateral contracts
When one party pays another party to perform an action
Examples of unilateral contracts
- when getting a reward
- through an advertisement
Describe the facts of the Carlill v The Carbolic smoke ball co.
- A company will give 100 pounds to any person that contracts the influenza colds after using their ball for 2 weeks.
- Mrs Carlill had taken the ball and contracted the virus the next year.
- The court concluded that for such a payment to be done, it had to be done under the clear terms of the offer,
What are bilateral contracts
This is a reciprocal arrangement between 2 parties where both parties have to carry out an action under the terms of the contract
what are collateral contracts
These act as secondary contracts to the main contracts and usually stands between the original parties but can include a third party
Reasons for collateral contracts
- Some new terms and conditions need to be added after being thought of after the main contract had been made
- There are errors in the main contract that need to be corrected
- a third party is involved
contracts may be in the form of:
- Written/speciality contracts
- Simple contracts
- Contracts under seal
What are written contracts
These are contracts that must be written under a formal document
examples:
- marine insurance
- conveyance
What are contracts requiring written evidence
contracts that require notes as evidence such as:
- a description of the parties to sufficiently identify them
- a description of the subject matter
- a consideration (the value)
- their signatures
examples:
- car insurance
What are simple contracts
These are contracts whose formation is not subject to any legal formalities
they can be made:
- Orally
- written
- Partly oral and written
- implied
examples:
sales of goods
What are contracts under seal
Contracts drawn by one party which are sealed and sent to the next party to be signed
examples:
- mortgage
- charge

- Substance of common law
- Doctrines of equity
- Certain Statutes of General Application
