What are civil liberties?
Protections against government; guarantee of safety of person, opinions, and property from random acts of government (freedom of religion, speech, press)
What are civil rights?
Reserved for those positive acts of government that seek to make constitutional guarantees a reality for all people (prohibitions of discrimination)
Do “aliens” get rights too?
Yes
Do states just have the same bill of rights as the national government?
No, they usually make their own
What is the 14th amendment?
“No state shall … deprive a person of life, liberty, or property, without due process of law
What is the clause relating to the establishment of a religion?
The establishment clause
What is the clause relating to the arbitrary interference of government in the exercise of religion?
The free exercise clause
What is pure speech?
Words used to convey ideas or emotions and listener usually participated voluntarily
What is speech plus?
Intended to involve bystanders, uninterested people, or even hostile groups
What is symbolic speech?
Actions and objects replace words in conveying ideas or emotional appeal
What are libel and slander?
Attacks against a person’s good name and reputation

Cannot impede flow of traffic or create excessive noise levels at inappropriate times
