What are the three federal courts?
Supreme court, circuit courts, and district courts.
What is the IRAC method of deciding cases?
ISSUE, RULE which rule of law applies to the case, APPLICATION how does the law apply to the facts and circumstances of the case, CONCLUSION what conclusion should be drawn.
Why can it be difficult to settle on a legal matter?
There is no one right answer to most legal questions, good arguments on both sides, judges and juries values effect decisions, court outcomes are not certain.
What is substantive law?
Define, describe, regulate, and create rights.
What is procedural law?
Outlines method of enforcing substantive law.
What is civil law?
Rights and duties between persons and governments (statutory and common law).
What is criminal law?
Wrongs committed against the public as a whole and is only statutory.
What is counter majoritarian difficulty?
A supreme court debate of should issues be decided by the courts or solved by the people. When do we overrule democracy?
