Situations contrary to professional standards or law/regulations
PRPG applies equally to employed members whether or not their employers are members or tax practitioners
Employers may find themselves in situations where put under pressure to act contrary to PRPG
What to do in this situation?
Raise concerns internally at an appropriate level and follow applicable procedures
Need to advise firms money laundering reporting officer
Aim to disassociate from matter
Explore other available routes- seek legal advice, whistle blowing
Consider whether need to look for alternative employment
Employees legal exposure
Employees can be sued along with their employers so also need protection
- Ensure adequate protection in employment contract
- Request employer includes a term in engagement letter saying that client can only sue firm/employer
- Ensure employers PII cover extends to employee and that employee continues to be protected after cessation of employment
Can also be sued by employers

If offering own private tax advice, need to ensure have requisite level of PII cover and comply with anti-ML obligations
