Protected classes
race, religion, sex, age, disability, veteran, pregnancy, marital status
varies by state: sexual orientation, gender identity
Protected class
anyone distinguished by special characteristic that could inhibit social progress
BFOQ= Bona Fide Occupational Qualification
trait or characteristic that is essential to perform the job in question
Any form of harassment includes:
sexual overtones, unwelcome advances, sexual favors, verbal or physical conduct
Quid Pro Quo “this for that”
abuse of power, job depends on sexual favors, promised promotion, threat of firing, demotion
Sexually Hostile Environment
offensive jokes, cartoons, pictures or conduct, not limited to sex could be race, religion, age, disability, origin
a) repeated behavior, b) offensice to reasonable person, c) recipient
