Case management and pre-trial hearings

Preliminary hearings:

When an indictable only matter is sent to the Crown Court (sent from the MC), a preliminary hearing will take place within 14 days of being sent if:

Answer 1

-the trial is likely to last more than 4 weeks
-there are case management problems to address
-one of the defendants is under 18
-there is likely to be a guilty plea

Question 2

MC send case to the CC. By when must the magistrates set a date for a PTPH (where there is no preliminary hearing)?

Answer 2

The magistrates must set a date for the PTPH within 28 days of sending.
