A

The presumption is against granting release on bail. Defendants generally have a right to bail, but this presumption is reversed for defendants charged with murder - presumption is against release.

What are the consequences of breach of bail conditions/failure to surrender to bail?

A

-if a D breaches their bail conditions, they can be arrested without warrant - bail can be withdrawn/more serious conditions imposed. Breach of bail conditions is not a criminal offence
-failure to surrender is a criminal offence
