What sets the rules that guide the division of powers in Canada?
The Constitution Act
Fiscal federalism
An approach that used a variety of mechanisms for transferring resources from the national government to its sub-national jurisdictions to help equalize their fiscal capacity and thereby allow all communities to have sufficient resources to allow them to provide roughly comparable levels of services.
Cash grants
Direct transfers from one level of government to another.
Tax room
An agreement whereby the senior level of government decreases its tax rates without increasing the total tax burden on the individual taxpayer.
Extra billing
User fees for services (may include co-payments and deductibles).
What does the Canadian Health Act define?
The terms and conditions that must be met by provincial insurance plans to qualify for full cash contribution from the federal government.
What are the five conditions of the Canadian Health Act?
Public administration, comprehensiveness, universality, portability, and accessibility.
Public administration requirement
Must be administered and operated on a non-profit basis by a public authority, designated by the province.
Comprehensiveness requirement
Must insure all insured health services that are provided to insured persons by the hospital and doctors.
Universality requirement
Must cover all insured health services for all insured persons under uniform terms and conditions.
Portability requirement
Coverage must transfer from one province to another if a person moves.
Accessibility requirement
Must provide insured health services to insured persons on uniform terms and conditions, and these services must be reasonably accessible to all insured persons.
Insured health services
Hospital services, physician services, and surgical-dental services provided to insured persons, but does not include any health services that a person is entitled to and eligible for under any other Act of Parliament or under any Act of legislature of a province that related to workers’ or workmen’s compensation.
Hospital services
Services provided in a hospital if they are medically necessary for the purpose of maintaining health, preventing disease or diagnosing or treating an injury, illness or disability.
Physician services
Any medically required services rendered by medical practitioners.
