A
- “the right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated… but upon probable cause…”
- police officers need probable cause in order to obtain a search warrant
- however, there are six ways a search can be conducted without a warrant
1. search after a lawful arrest
2. stop and frisk
3. plain view
4. hot pursuit
5. vehicle searches - exclusionary rule: if the police officers do not obtain evidence with a legal warrant (or the exceptions) then that evidence cannot be used in court
