What is deliberate act?
“Intent” means that act or omission must be done deliberately. The act or omission must be more than involuntary or accidental.
Give an example for deliberate act?
A person intends to strike the victim with their fist on the right side of the face above the eye.
What is intent (2 parts)?
There must be intention to:
- Commit the Act
- To get a specific result
What is “To get a specific Result”
Aim, Object or Purpose
Whose responsibility in proving intent?
The onus is on the Prosecution to Prove an Offender’s intent beyond reasonable doubt.
What was found in R v Collister?
2x Police Officers were charged with demanding with menaces after causing a man to believe he would be arrested for soliciting homosexual acts unless he paid them money.
Although no express demand for money was made, it was held that the Defendant’s intent could be inferred from the Circumstances.
