When can you arrest someone
DABS
During - is committing an offence
After - an offence has been committed
Before - about to commit an offence or reasonable grounds to suspect about to
Suspect - reasonable grounds to suspect an offence has been committed and that person is guilty of it
Necessity criteria for arrest
COPPLANED
Child / vulnerable person - to protect from the offender
Obstruction - to prevent an obstruction to the highway
Physical injury - caused to themselves or others
Public decency - prevent against
Loss or damage - to prevent loss of damage to property
Address- cannot ascertain or reason to doubt
Name - cannot ascertain or reason to doubt
Effective investigation - allow prompt and effective investigation
Disappearance - prevent prosecution behind hindered by disappearance of the person in question
What must you tell a person being arrested
They are under arrest

When can hand cuffs be used on arrest?
Only use hand cuffs is there are reasonable ground to believe that an unrestrained prisoner will use violence or try to escape custody
