advantages of legislative process Flashcards
Name the 4 advantages
.democratic
.full reform
.broad policy
.consultation
How is the legislative process democratic?
Law is made by elected representatives and there is a vote every 5 years where MPs may be voted out of office so the law makers change every 5 years
Why is it positive that the legislative process is democratic?
No one party stays in control indefinitely so if there’s a drive for change it will happen. It avoids a dictatorship and respects public opinion
How does the legislative process show full reform?
Whole areas of law can be written in one act which provides one piece of legislation on a topic. This makes the law more accessible. A judge can only change a small part with a precedent
Why is it positive that the legislative process can be fully reformed?
Leads to more consistent decisions and saves time and money
Example of full reform?
Michael Gove’s deucation reform
How does the legislative process show broad policy?
Set broad policies and delegate power to parties. Structure is set out by parliament but allows specialists to include what’s necessary to the act
Why is broad policy good?
.gives power to departments and ministers
.provides more suitable legislation
what is consultation?
Parties are consulted on changes to the law before the bill is drafted to allow the govt to take opinions and concerns into account. Each bill is thoroughly discussed by parliament
Why is consultation good?
.happen at second reading and committee stage so gets ministers involved
.green and white paper have a consultation stage so it’s informed and explained
