ADM-18 When does harassment become unlawful?
When enduring offensive conduct becomes a condition of continued employment -conduct is severe or persuasive enough to create a work environment that a reasonable person would consider intimidating, hostile, or abusive.

Offensive jokes, slurs, name-calling, or other derogatory comments.

ADM-18 How is sexual-harassment defined?
-Unwelcome sexual conduct such as sexual advances, request for sexual favors, and or other verbal or physical conduct of a sexual nature when:
A) submission or rejection of sub such advances is made a term or condition of employment, (“quid pro quo” or this for that)
B) such advances have the purpose or effect of unreasonably interfering with work performance.
C) Such advances have the purpose or effect of creating intimidating, hostile, humiliating, or sexually offensive work environment.
ADM-18 What does it important to note about sexual harassment definition’s?
It is not necessary to meet the threshold of sexual harassment as defined by law to be considered a violation of this policy.
ADM-18 What are some examples of sexual harassment?
- Direct sexual advances or assaults
- Sexual inquiries, or jokes
- Derogatory comments about person sex, sexual orientation or gender identity or expression
- Whistling or cat calling
- Offensive or unnecessary touching, pinching, patting
- Display of sexually suggestive posters, photographs, or objects
- And employee receiving job benefits for sexual favors (quit pro quo)
Who can victims of sexual harassment be?
Person of same or different gender,
Is third person who is not intended as a target with the sexual harassment or conduct. Basically can be either gender or any employee in certain circumstances some people who are not employees
What may be some of the liability and sanctions?
Employees may be personally liable if they engage in unlawful harassment, sexual harassment or discrimination. An employee found to have engaged in these behaviors is subject to disciplinary action up to and including termination. Supervisors may be personally liable if they knew or should’ve known about incidents and did not take appropriate corrective actions. The department may not be held responsible if they can show that they took prompt inappropriate corrective action.
What are the complaint procedures for unlawful harassment, sexual harassment and discrimination under ADM – 18?
- Notify your supervisor who will then assist and reporting the complaint to HIU
- Fax a copy of SP387 unlawful harassment, sexual harassment and discrimination complaint form directly to HIU
- Forward the original SP387 to HIU
- Report complaint to the director of human resources Who shall forward it to HIU
- Report complaint to the diversity office of the office of diversity an equal opportunity who shall then forward it to HIU
- Report complaint to the chief legal counsel who shall then forward to HIU
What shall HIU do when a complaint is sent to them?
- HIU shall promptly:
- Respond to the complaint
- Review complaint
- Determine if an individual is a member of a protected class
- Determine if the contact meets the definition of harassment discrimination
- Perform an intake and may make recommendations
- If HIU determine an investigation is required complaint is forwarded to Commonwealth human resources division’s COE(Center of Expertise).
- If possible ensure interviews by HIU digitally recorded
- Consult procedures outlined Within the department resolution process as outlined in affirmative action plan
- Make a report of findings and Forward the report to the DST Commander
Once HIU completes confidential reports what will happen?

What is the last step in the complaint procedure?
HIU shall notify the department office of diversity and equal opportunity of complaints of unlawful harassment or discrimination.
What are the responsibilities of supervisors for unlawful harassment and discrimination?
Aggressively monitor the workplace to prevent and detect harassment
- Take appropriate corrective action to stop this
- Immediately report incidents to HIU
- Assist any employee in filing a complaint or obtaining information
- Contact the HIU for any info or guidance
What’s the responsibility of all employees regarding harassment and discrimination?

What happens if there’s retaliation for complaints of sexual harassment and discrimination?
Any retaliation against someone who complained shall not be tolerated. And such retaliation shall be a violation of his policy and shall be reported to HIU and to/from format.

Cases that are approved for an alternate resolution shall be classified as referred.
What happens in all cases of complaints of harassment?
All cases, and record shall be made in the case file. All findings, withdrawals and referrals shall be reviewed and approved by the division commander of standards and training.

Any complaints sustained shall be deemed a violation of ADM – 18 and shall be handled in accordance with rules and regulations of the department as applicable.

The department may allow personnel, on full duty status or alternate duty status (As specified in ADM – 11C maternity leave and guidelines) to work paid details.

ADM-25 What is the definition of a pay detail?
A voluntary assignment paid for by an outside entity, which has been authorized by the Colonel/Superintendent.
ADM-25 What is the definition of scheduled work hours?
A regular shift or tour of duty consisting of 8 1/2 hours.

When may members not accept a detail?
If doing so would require the member not to work a regularly scheduled shift or attend other work obligations which the member is aware.
When may a member not cancel a detail?
May not cancel a detail in order to accept another detail or overtime assignment.
What happens in the event the detail hours exceed the hours of work allowed in a 24 hour period?
The member she’ll not be allowed to alter the starting time of their next assigned work shift, but shell use accrued personal leave on vacation leave to offset any conflicts within their scheduled work hours.
When does a member receive time and a half detail pay?

The member assigned shall determine the need to use accrued personal or vacation leave to ensure prompt rival at a detail or when reporting boarding for their tour of duty assignment. Remember must decline to detail if they choose not to use the appropriate accrued leave.

- Shall not request or work overtime or details within 24 hours from the start time of the regularly scheduled work shift when sickleave was taken for:
- Personal illness or injury
- Presence of a member of their work location would jeopardize your health of others to exposure to a contagious condition
- The members spouse, child, parent, or spouse’s parent, or relative living in the members household, is seriously ill.
ADM-25 What is the exception to the sickleave pay detail rule?
A member who works at least four hours or more consecutive hours of the regular shift in which sickleave was granted as outlined in ADM – 11 shall remain eligible to work pay details in overtime
How many troops may a member choose to work details in?
Members may request only one troop as a primary choice for request paid detail assignments.
ADM-25 What is the form does a member use to choose their primary choice for details?
The SPD –3 Request for Paid Detail form.

- Maintain control over vehicle assignment and reassignment
- Assign vehicles based on the year, condition, and mileage
- Assign vehicles to individual personnel based upon availability and particular assignment
- Prior to the assignment or replacement of a vehicle:
- They will analyze inventory reports of affected vehicles
- Notify members of scheduled vehicles assignments or appointments and
- Inspect and verify vehicles being turned in for mileage, damage, operational status, cleanliness, and or issued equipment.
ADM-19 What happens if a personnel fails to report with their assigned vehicle and or issued vehicle equipment?
They shall not be issued a new or replacement vehicle.
ADM-19 For vehicle disposal what is the Fleet Administrators responsibilities?
- Maintain standards in criteria for determining when a vehicle is suitable for disposal
- Ensure all usable equipment parts are removed in the vehicle is appropriately prepared for disposal
- Provide the Commonwealth of Massachusetts operational services division with the vehicle identification number of disposed vehicles.
ADM-19 When a member is on extended leave in excess of 30 days what happens to their vehicle?
-The assign vehicle along with it should vehicle equipment and department issued fuel card, Transponder and snow gate access cards shall be returned To their Troop/Section/unit Commander.
ADM-19 What’s the responsibility of the Trooper Troop/Section commander when a member is on extended leave and in their vehicle?
The Troop/Section commander she’ll notify the Fleet administrator when issued vehicles and equipment are returned due to extended leaves, and advise the location of the vehicle and the equipment.
ADM-19 What’s the fleet administrators responsibility when A member is on extended leave interns in their vehicle to their trip/Section Commander.
Fleet administrator will reassign the vehicle based on the needs of the department, and if practical, members returning to full duty should Be reassigned the same vehicle.
ADM-19 What does fleet administrator do with forfeited/donated vehicles?
The fleet administrator has the authority to accept or reject vehicles on behalf of the department. Any vehicle excepted by the department shall be:
- Delivered to the Fleet section with appropriate documentation for example order of forfeiture, certificate of title
- Inspected for mechanical and or physical safety defects prior to acceptance and registration
- Assign a fleet vehicle computer number
- Assigned by the Fleet ministration are based on the needs of the department.

ADM-19A What’s the policy of the department for vehicle use and maintenance?
Department vehicle shall be maintained in a safe, clean in serviceable condition for reasons of safety, operational readiness, and to enhance a Department public image. For the purpose of this policy, members shall include sworn and civilian employees of the department.
What is new to ADM–19 regarding vehicle used to Maintance?
Civilian employees of the department has been added to this policy.
ADM-19A List the required equipment for vehicles used for patrol purposes?
At a minimum vehicles use for patrol shall be equipped with:
- Emergency lights and siren
- Medical kit
- Fire extinguisher
- Radios
- Detainee safety barrier for Marked, semi Marked, low profile vehicles.
- Conspicuous markings for Marked, semi Mark vehicles low profile vehicles including but not limited to reflective chevrons, pinstriping configured as determined by the Fleet Administrator and
- Call other equipment issued with, I’m a part of the vehicle according to Department specifications.
ADM-19A When shall vehicles and equipment be inspected?
At the beginning of each shift by the vehicle operator
- for damage, contraband, and or evidence before an after transporting detainees
- Quarterly by station/unit commanders
- In preparation for line or staff inspections
- Upon request by the Fleet administrator
ADM-19A What happens if there’s damage to the department vehicle caused by a arrested, detained or person being transported to court?
Any damage to the vehicle Shall be immediately reported in writing to your immediate supervisor and to the Fleet administrator in order to collect restitution. The Fleet coordinator shall make arrangements for repairs through the Fleet section.
ADM 19A What are members not allowed to do with your vehicle?
They shall not
-install non-issued equipment and or add or remove window tint in any department vehicle without prior written authorization from the Fleet administrator.
-The department vehicle shall not be altered without prior written authorization from the Fleet administrator as well.
ADM-19A What are members have to do if they want to request to install non-issued equipment and or remove window tint in Department vehicles?
They should make written request to the appropriate channels to the Troop/Section/Unit commander
- Agree and writing to assume all responsibility for this equipment in any damage cause to the vehicle associated with the removal of equipment
- Assume all costs associated with the purchase, installation, and service or maintenance fees associated
- Notify Fleet administrator of the location where the professional installation of the equipment shall occur
- Immediately remove any equipment as directed by the Fleet administrator or proper authorities.
ADM-19A Once a member request to install or take out equipment out of the vehicle what happens?
Troop/Section/Unit commander shall review our request and forward approved request to the Fleet administrator or proper authority.
ADM-19A What shall the fleet administrator do to any requests for equipment in vehicles?
-Approve or deny all written requests
-Forward the written approval or denial to the appropriate Troop/Section Commander
ADM-19A Explain vehicle ornamentation?
Member shall not affix/install Vehicle ornamentation or any department vehicle, including vehicles assigned to various authorities or other government agencies unless approved in advance and in writing to the deputy superintendent and fleet administrator
-Members shall not Remove, cover, or obscured the display of the issued registration plates or remove Cruiser markings from any department without prior authorization. Vehicle ornamentation can include stickers
ADM-19A What should a member do for recalls to their department vehicle?
Members who are assigned a vehicles that have recalls shall, upon notification of a recall, contact an authorized service facility to schedule an appointment, and
- make sure the recall work is completed as ordered,
-Forward the repair order to the Fleet section, and
- retain a copy of the repair order.

All members are required to have their currently assigned department vehicle routinally serviced and have an oil change at a department fleet facility every 9000 miles for six months whatever occurs first.
Daily vehicle checks as well for regular duty.
ADM-19A Explain fuel cards given to members?
Fuel cards are restricted to the purchase of fuel for department vehicles only.
- Sign a receipt when issued a fuel card
- Enter fleet vehicle computer pin and current mileage when fueling
- Fuel vehicles at authorize facilities
- Purchase regular unleaded fuel only
- Use self serve facilities when possible
- Ensure Vehicle fuel tanks for mains at least half full at all times and
- Turn in fuel cards through channels to Fleet administrators upon any leave in excess of 30 days.
ADM-19A What is important to know about department of vehicles at all times?
Members shall not leave their vehicles running while unattended, unless within the scope of their duties. Example motor vehicle stops, details pursuant to MGL chapter 19 section 13.
ADM-19A Explain the use of Fastlane transponders in snow gate access cards

- Members responding to an emergency vehicle shell operate the vehicles with due care in regard for the safety of all persons in property

- May drive through an intersection, contrary to traffic signs or signals, after coming to a full stop, and then proceeding with caution

It is an Executive Order #241 that states that all occupants shall properly wear seatbelts when traveling in any state on vehicles as mandated by executive order of the governor number 241.
ADM-19A For responses of non-emergency/non-life-threatening situation how should you drive your vehicle?
Emergency lights and or siren need not be used. Observe all traffic laws and regulations.

No object shall be placed on or in the path of airbags For safety reasons. Airbag switches shall not be installed in any department vehicles without prior written approval of the administrators.

Automated vehicle locator technology is an electronic means for automatically determining and transmitting the geographic location of department resources to include personnel, vehicles and crafts. Examples of AVLs include but are not limited to:
GPS equipped radios, cellular devices, mobile data terminals or MDT’s and standalone hardware Devices
ADM-19B For AVL purposes what is the definition of on duty?
Any period of time that employee is performing any department function or using a department vehicle or resource. This is whether performance of duties, assigned or self initiated, uniform or plane closed patrols, investigative and administrative functions, traveling to and from work, court, pay detail or training and or commuting to and from home.
ADM-19B For administrative purposes what does the members have to know about AVL technology?
-Unless expressly exempt by the Colonel all on duty members with an AVL shall be activated until off duty.
-All members shall report technical problems to the AVL to their supervisor and to the communication section. Malfunction Shall be recorded in the DAJ by the MEMBER*
-Supervisors and communications § shall immediately report any malfunctions of the AVL system to the executive office of Technology services and security(EOTTS)
ADM-19B What is a Troop/Section/ unit commanders responsibilities for AVL?
At least once during a shift commander shall determine the AVL systems of each on duty member, under their command, are working properly.
ADM-19B What do members have to know about the AVL equipment?
- No member shall use or install any equipment or items that interfere with the AVL equipment
- Member shall not tamper with it or it may result in disciplinary action.
ADM-19B What do you have to know about audits of the AVL technology?
The Colonel or designee may authorize audits of the AVL device. The Colonel, Deputy Superintendent, Division Commanders and or designees shall have access to the AVL data for any lawful, relevant purpose, including but not limited to:
situational awareness, response time, analysis and improvement of patrol tactics, improvement of officer safety, criminal or personal investigations and the enforcement of existing work rules regulations policies and procedures.

A member designated by the Colonel, responsible for all weapons and ammunition under their control or in storage at the Armory.

- Maintaining an Accurate inventory of all weapons
- Maintain all SP 9 Records of Issue and SP 255 Equipment Transfer/Disposition forms
- Update department body armor/weapons inspection database
- Maintain an inventory of ammo in firearms
- Ensure that sufficient quantities of ammunition, parts, and supplies remain at the Armory for department use
- Coordinate all firearms repairs
- Conduct training for all members
- Ensure each station/Section/unit has a suitable bullet trap or body armor for use in unloading firearms and
- Be available to provide temporary replacement firearms.
ADM-20 What should happen when a firearm is issued or transferred?
ADM-20 What are the responsibility of the commanding officers that are having firearms assigned to a specific station/Section/unit?
The commanding officer shall complete a SP 255 equipment transfer/disposition form with the following information on it:
- Description of fire arm including serial number and
- Date and location of assignment
- They are also responsible for forwarding one copy to the armor and retain a copy for station/Section/unit records.
