What are the main agencies of the Criminal Justice System?
Probation Services, CPS, Police, Prison Services, Courts
What is the Police’s relationship with other agencies?
Courts - Those who are denied bail are taken back into police custody until they can be taken to prison.
CPS - They provide evidence to the CPS and gain advice for them to know if they have enough evidence to convict.
Prison + Probation - They arrest prisoners who have been recalled to prison for breaching their licence.
What is the CPS’s relationship with other agencies?
Police - They advice the Police during the early stages of an investigation, and tell them if they have enough evidence to possibly convict. They also review to cases to see if the public interest requires a prosectution.
Courts - The CPS prepares and presents cases at court.
What is the Courts’s relationship with other agencies?
Police + Prison - Ensure safety of safe delivery of prisoners to courts
-Use the pre-sentence reports they’re given by Probation Services
-The Sentencing Council for England and Wales produces guidelines for Courts to use.
What is the Prison’s relationship with other agencies?
Court - Prison services carries out custodial sentences the Court imposes and supervise defendants remanded in custody (denied bail). They also facilitate visits from defence lawyers to their clients in prison.
Police - The police recall prisoners to prison if they breach their licence during probation.
Probation - Prisoners sentenced up to 2 years are released halfway and put on licence. After this they’re supervises for an extra 12 months.
What is Probation’s relationship with other agencies?
Prison - They attend meetings in prison to provide reports to help determine whether a prisoner should be released and under what conditions.
Courts - They create a pre-sentence report, supervise offenders given a community sentence and supervise drug testing.
Police - If someone breaches their licence, they get the police to recall them to custody.
What is a pre-sentence report?
A report made up of information about an offender which includes their background and childhood to help Court’s decide a sentence.
What is MAPPA?
A process involving multiple agencies working together to protect the public by managing the risks of violent + sexual offenders in the community via a meeting.
The agencies involves are Police, Prison and Probation. They create a plan to manage this.
