Article 253 Revocation, suspension and variation
of certificates, licences:

Order, pending inquiry into or consideration
of the case.
2) The CAA may, on sufficient ground being
shown to its satisfaction after due inquiry,
revoke, suspend or vary any such … licence…

Concerns about the competence of a controller
to provide an Air Traffic Control service may
arise as a result of:
a) an incident;
b) failure of a competence check;
c) deterioration in competence;
d) poor technique or judgement, or similar
factors.

What is an MOR?

A

Mandatory Occurrence Report

Primarily Reporting action by MOR through the
ECCAIRS2 Portal.
ANSP’s may have an ADREP (Aerodrome Report)
compliant format other than the Portal.
If ATCO talks to pilot, these details shall be
included:
Contents of discussion
whether or not the controller considers the matter closed
from a flight safety point of view.

Infringement of legislation

A

When a possible infringement of legislation is
involved, controllers should follow the guidance
contained in MATS 1, sec 6 ch 4.
Suggest you discuss the issue with local
management before filing as this starts a legal
process. It accuses the pilot of breaking the law
– (Illegal)
Alleged breaches of Air Navigation Legislation
(ABANL) are to be reported on form CA939.

Describe incident in detail. Include:
Identity of aircraft with tracks/times;
Any loss of Separation;
Statement to degree of impact on ATC operations.
Reports on CA939 are to be sent to the CAA
Investigation and Enforcement Team (IET) by
post or by email.
Essential that reports meriting prosecution -
dealt with expeditiously.
Delays in preparation of supporting documents -
forward CA939 at once, endorsed with
‘additional documents to follow’.

Further UK reporting procedures are:

A

SRG 1410: Report of duty in excess of SRATCOH
This may require duplication through the MOR
scheme according to regulation (EU)376/2014
(UK). The MATS 1 is due to be updated in due
course.
Units may have local reporting systems in place
– check with UTO.

CHIRP - Confidential Human Factors Incident
Reporting Programme (www.chirp.co.uk).
Enhances aviation safety, by providing
independent confidential reporting system.
Disidentified information can be made available
to those who can take action to remedy the
problem.
Individuals able to raise issues of concern
without being identified to their peer group,
management or CAA.

Aside from trained local Accident investigators
on unit, the AAIB is a vital element of
investigation work.
All accidents must be relayed to AAIB as soon as
possible for initial investigations to be
commenced.

A
  • Nationality, registration marks of aircraft
  • Commander’s name
  • Name & nationality of person under restraint, reasons for his journey
  • Description of the incident, position of the aircraft at the time
  • Names of up to 3 witnesses
  • ETA at aerodrome of intended landing

  • Treat as Incident involving Safety
  • Reasonable effort to identify aircraft a.s.a.p.
  • Enlist aid of ACC Watch Manager
  • Might it be a military aircraft - beyond civil means of identification
  • Do not express an opinion, to the reporting person, as to likely source of the matter.

  • Balloon type and whether carrying a load
  • Position of the balloon site
  • Last observed height
  • Direction and speed of drift

  • Identity of any other vessels in immediate vicinity
  • Any photographs taken?
  • ATC Unit must pass report to ACC without delay
  • ACC Watch Supervisor passes the report to Coastguard Maritime Rescue Coordination Centre.

A

Obtain details following the MATS list set out
Section 6, Ch5
- Take pains to be accurate, not every report is a hoax or imagination
- If considered to be of significance to flight safety then subject to MOR.
- Consider unidentified aircraft procedure

A

ATCU obtains as much information as possible
Pass details immediately to parent ACC:
- Name and address of informant
- Time boom was heard
- Description of sound
- Details of any alleged effects on persons, property or livestock

ATC Watch Log

A

Detailed watch log to be maintained by each
ATC Unit - instructions appear on inside front
cover - it is to be treated as a ‘Restricted’
document
Controller in charge to inspect log daily and take
note of significant entries and sign
Log will be inspected during annual inspections
by ‘ATS standards department’
AAIB have authority to impound - a
replacement will need to be opened
