Q

What is the difference between a stakeholder and a statutory consultee?

A

Statutory consultees are organisations and public bodies, defined by statute, which local authorities are legally required to consult before reaching a decision on planning applications.
Statutory consultees are duty bound to respond within the relevant planning deadline. Their views are a key consideration during the planning process.
Examples: Adjoining landowners, Historic England, Natural England, parish councils, Highways Authority, utility companies, National Park Authorities, EA.

Stakeholders are organisations, public bodies or individuals who may have an interest in a proposed development. There is no legal requirement to consult with them unless it is a major application, in which case there must by public consultation.
Examples: Wildlife trusts, Woodland trusts, police commissioner, Community groups, Forestry commission, sports England, HSE, MoD.

Q

When would you consult with a stakeholder?

A

As early on in the planning process as possible before submitting a planning application. This can minimise problems with the planning application, as their feedback can be taken on board and the scheme designed to reflect this.

Q

I see you one of your clients is xxx, can you tell me a little about them?

A

example: Dandara.
Dandara are a medium-sized house builder. Define have worked with Dandara for several years now, and at any one time tend to have several projects on the go with them - they are one of our biggest clients. We are generally appointed by them via direct appointment - repeat business is ensured by maintaining the established professional relationship we have with them.

Q

Have you experienced any difficult clients?

A

Whilst working on a LVA for a small project, we experienced a slightly tricky client who wanted us to downplay our assessment of landscape and visual effects, and reduce the amount of mitigation planting on our landscape strategy to reduce cost.
In this project I learnt a lot from my colleagues, who had to professionally explain to the client why the effects could not be downplayed. however, they would not compromise on the mitigation, so we just had to ensure that them going against our advice was documented in an email chain, so we cannot be liable for it failing planning for not having enough mitigation planting.
