Define harassment
Conduct that is directed at or offensive to another person or persons in the workplace, and that the individual knew or ought reasonably to have known would cause offence or harm. It comprises any objectionable act, comment, or display that demeans, belittles or causes personal humiliation or embarrassment and any act of intimidation or threat. It includes harassment within the meaning of the Canadian Human Rights Act.
What is hazing?
Harassment involving initiation rights.
What is the procedure for addressing a harassment complaint?
Formal and Informal and mediation through Conflict Management Centre (CMC).
Informally:
- Victim may tell the respondent to stop.
- Victim may use a third party mediator (CMC or COC).
- May use the CMC.
Formally:
- Submit complaint to immediate supervisor or Harassment Advisor, Chaplain, Medical Officer, PSO.
What happens once a complaint is submitted?
Complaint makes its way through CoC to CO. CO orders investigation and informs Base Harassment Advisor. Normally a Summary Investigation. Contacts MP if it is a possible sexual misconduct.
How long before CO must provide interim reply?
Within 14 days of receipt of initial complaint.
Define Sexual Misconduct
Acts that are either sexual in nature or committed with the intent to commit an act or acts that are sexual in nature.
Is there duty to report?
Not anymore.
As OOD what do YOU do if you receive a complaint?
Ensure safety of the member (separate from respondent). Provide support contacts and references to the member. Explain obligations and procedures. Provide information (SMRC Decision Tree).
