What are the two types of bills?
Public: deal with matters of national interest
Private: grant special powers/ benefits/ exceptions to persons such as corporations
What is a legislature?
A deliberative assembly that has the authority to make laws for a political entity such as a country, a province, or a city.
Legislation is passed through a fairly complex process, and the complexity often depends on the level of the legislature.
- Canada has both provincial and federal parliament
What is the nursing legislation in Canada
Each province/territory has its own legislature (parliament).
The scope of nursing practice in a province/territory is determined by the legislature in that individual province/territory.
The scope of nursing practice can change at the will of the government in power.
What is the nursing act?
Lays out how nursing as a profession is regulated in Ontario.
Protects title: Nurse
- must pass nursing school, the NCLEX and register with the CNO
Gives CNO its mandate, provides entry to practice competencies, defines the controlled acts, quality assurance and looks after the profession misconduct
- Gives RNs and RPNs who meet certain conditions the authority to initiate specific controlled acts.
What is the Regulated Health Professions Act (RHPA)
26 health professions, including nursing - has its own regulatory body
Regulatory bodies have public representation and controlled by the ministry of health
The RHPA outlines 14 Controlled Acts.
- Controlled acts are action considered harmful if done by unqualified people

RNs and RPNs are authorized to perform 5 of these controlled acts.
Which controlled acts are RNs and RPNs allowed to do?
- Perform a procedure on tissue below the dermis, below the surface of a mucous membrane
- Administering a substance by injection or inhalation
- Putting an instrument, hand, or finger:
- Beyond external ear canal
- Beyond the point in the nasal passages where they normally narrow
- Beyond the larynx
- Beyond the opening of urethra
- Beyond the labia majora
- Beyond the anal verge
- Into an artificial opening into the body - Dispensing a drug
- Treating, by means of psychotherapy technique, delivered through a therapeutic relationship, an individual’s serious disorder of thought, cognition, emotional regulation, perception or memory that may be seriously impair the individual’s judgement, insight, behaviour, communication or social function
What is the CNA?
Canadian Nursing Association
National and global voice of RNs, NPs, LPNs/RPNs, retired nurses across 13 provinces and territories
Purpose: Professional / educational/ political.
Offers specialty certification
What is Canadian Association of Schools of Nursing (CASN)?
Purpose: Professional / educational.
Membership: Voluntary.
National voice for nursing education, research, and scholarship
Establishes and promotes national standards for nursing education.
Canadian Nursing Students’ Association (CNSA) affiliated with CASN.
Fosters excellence in the academic nursing educators role and provides recognition and merit for nursing specialist, expertise, competencies etc in canada
Certifications: CCNE (certified nurse educator), simulation educators
What is Canadian Nurses Protective Society (CNPS)?
- Non profit organization created by nurses for nurses –> offers legal advice, risk management services, legal assistance and professional liability protection related to nursing practice in canada
Purpose: Legal Assistance
What is Canadian Nursing Students Association (CNSA)?
National voice of canadian nursing students with the goal increasing legal, ethical, and educational aspects of nursing
Dedicated to the positive promotion of nurses and the nursing profession
Who sets the scope of practice for nurses in Ontario?
The nursing act and CNO
What is the purpose of the CNO?
Regulatory body; protects the public by making sure that nurses registered in Ontario have met, and continue to meet, the requirements of the profession.
Is membership to the CNO voluntary?
No. It is involuntary
