Define fitness to practice
When someone is fit to practice , they have the knowledge, skills, and character to practice their profession safely and effectively
What is the purpose of FTP?
Deigned to protect the public from those who are not FTP
If someone is not FTP what may that mean?
- should not practice at all
- be limited in what they are allowed to do
What HCPC standards can be breached with FTP?
- standards of proficiency
- standards of conduct, performance and ethics
What types of cases are considered for FTP?
- misconduct
- lack of competence
- conviction or caution
- physical/mental health
- a decision made by another health/social care regulator
What are examples of misconduct?
- fail to provide adequate care
- fail to maintain professional boundaries
- breach of confidentiality
- falsely claiming sick leave
What are examples of lack of competence?
- poor record keeping
- inadequate professional knowledge
- inadequate risk assessment
- poor clinical reasoning
What are examples of caution or conviction?
- theft or fraud
- sexual offences
- drink/drug related offence
- violent offences
What are examples of physical/mental health?
- unmanaged serious mental illness
- untreated alcohol/drug dependance
Who can raise a concern?
- members of public
- employers
- police
- health care professionals
When can impairment be found by the HCPC?
- dishonest/abused trust
- exploited vulnerale ppl
- health problems
- fail to respect service users right
What can the HCPC not do?
- give legal advice
- fine registrants
- make a registrant apologise
- etc
How do you raise a concern?
- by post or email
- must complete a form
How much punishment should be put in place?
The minimum action necessary to ensure public protection
What sanctions can be put in place with FTP?
- refer cases for mediation
- take no action
- impose caution orders
- impose suspension orders
- strike off

What occurs when no action is taken in FTP?
No action- panel must provide reasons to explain this decision
What happens when an FTP case is mediated?
- a case that has had no further action taken, they can refer a case for mediation
- intended to resolve issues between registrant and other party by meeting and discussion
What is a caution order in regards to FTP?
- not restrict registrants practice but will appear on the register
- can be imposed between 1-5 years
What is a conditions of practice order?
- allows registrant to remain in practice subject to restrictions which reflect on panels findings
What conditions typically cover conditions of practice?
- education and training requirements
- practice restrictions
- supervision
- treatment
- personal development
What is a suspension order?
- prohibits registrants from practicing their profession
- imposed for specified period of up to one year
What is a striking off order?
- removed registrants from the register and prohibits them from practicing their profession
- last restort
What are interim orders?
- prevents registrant from practicing or places limits on their practice until the case is heard
What is the HCPTS?
Health care professions tribunal service if the fitness to practice adjudication service of HCPC
What can a registrant do if they believe the outcome is wrong?
- appeal the panels decisions to high court if they feel the decision is wrong or unfair
