What is consent?
Consent is a voluntary, uncoerced decision made by a sufficiently competent or autonomous person on a basis if adequate information and deliberation to accept rather than reject some purpose course of action
When is consent valid?
- when the patient has capacity
- when consent is given voluntarily
- when the nature if the treatment has been understood by the patient
What is informed consent?
Consent that requires disclosure, understanding, competence and volunatariness, the patient must understand the nature in order ton make an informed decision
What is implied consent?
The assumption that a person has given permission for an action which is inferred in his or her actions, rather than expressly or explicitly provided
When can you assume consent?
- in an life-threatening emergency and they cannot provide consent
- a person that has been assessed under the MHA
- a person is a risk to the public with a serious communicable disease
What are the 7 principles of confidentiality?
- justify the purpose for using confidential info
- dont use personal data unless needed
- use minimum necessary personal data
- access to personal confidential data is on a need to know basis
- Everyone with access to personal data should be aware of responsibilities
- comply with the law
- duty to share info is just as important as duty to protect info
