Section 7 Victims Rights Act 2002
Treat all victims with courtesy and compassion, respecting their dignity and privacy
Section 8 Victims Rights Act 2002
Victim or member of their family should have access to the following services
- welfare
- health
- counseling
- medical
- legal
Section 11 Victims Rights Act 2002
Be given as soon as practicle information re Programmes, remedies, or services available to the victim
Section 12 Victims Rights Act 2002
As soon as practicle be given information relating to:
- progress of the investigation
- charges filed or action taken
- date and place of proceedings
- role of the victim as a witness
- outcome of proceedings
Section 51 Victims Rights Act 2002
Return of property to the victim asap once the exhibits are no longer required
Who is a victim under the Victims Rights Act 2002
- Person who has an offence committed against them
- Person physically injured, lost / damaged property from offence committed
- parent or legal guardian of CYP offence committed against ( unless charged or convicted of the offence )
- immediate family member of victim ( dies / incapable ) because of offence ( unless charged / convicted )
What is meant by immediate family
- spouse, civil union / defacto partner
- child / step child
- brother, sister, or step-siblings
- parent / step parent
- grandparent
What is meant by incapable
Person in coma,
Someone who can’t communicate decisions,
Can’t look after themselves
What other people does victim also cover
Someone that experiences emotional harm
Parent / legal guardian of CYP if CYP suffering emotional harm
Domestic violence sufferer or CYP of that person
Section 29 Victims Rights Act 2002
Covers what is a specified offence, usually offences of a secual nature. Responsibility of Police to understand if specified offence and right to be added to Victim Notification Register

Bail
Release
Escape
Death
