List the three provisions embodied in the US Constitution.
- Federalism
- Enumerated Powers
- Separation of Powers/Checks and Balances
Recall the branch of government that establishes military authority.
The Executive Branch
- The distribution of powers and responsibilities to all levels of government
- States were individual governments
- Townships and counties are basic units of government
Federalism
The US Constitution places limits on the power of the Federal Government
Enumerated Powers
Government is divided into three equal branches
The goal is that each Branch of government limits the other Branch’s natural desire to acquire more power
The Congress is thought to be the most powerful as it is a direct representation of the people.
Separation of Powers/Checks and Balances
Recall the Amendments to the US Constitution that governs military officer authority
1, 2, 3, 4, 6, 7, 8, 9, 10 (The entire bill of rights except for #5)
Restricts military officers from considering the following when making decisions: Gender / Religious affiliation / Race / Political Associations
First Amendment
Prohibits military officers from taking weapons from the public
Second Amendment
Prohibits the military from forcing public to house them
Third Amendment:
Prohibits the military from searching the public or other military members without a warrant or probable cause. Military Commanders do control military installations and are allowed to search most areas under their control.
Fourth Amendment:
Prohibits the military officer from punishing members for crimes without a trial (Article 15s are the exception, however the accused can refuse an article 15 and request a trial)
Sixth, Seventh, and Eighth Amendments:
States that just because a right was not mentioned in these Amendments, it doesn’t mean that the government can use this as an excuse to deny these other rights.
Ninth Amendment
Was adopted to reassure people that the national government would not swallow up the states. It states: “The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.”
