Guilty State of Mind
Act that must have been done intentionally.
Motive
Reason behind doing something
Crime Elements
- Premeditation
- Deliberation
- Malice
Felony
A crime where the penalty is imprisonment for more than a year (for criminal trial).
Misdemeanor
Less serious than Felony; a crime where the penalty is one year or less (in criminal trial).
Principle
The person who commits the crime
Accomplice
Someone who helps the principle commit the crime
Accessory Before the Fact
Person who orders the crime/ helps the principle commit the crime but isn’t present when crime takes place.
Accessory After the Fact
Person who knows that crime was committed, helps anyone involved with escape (can be charged with harboring fugitive).
Crime of Omission
When a person gets in trouble for the failure to act (criminal law).
Preliminary Crimes
When the intended crime is stopped before it can take place.
Solicitation
When someone asks/ commands another person to commit a crime.
Attempt
An attempt to commit a crime itself.
Conspiracy
An agreement to commit a crime, involving 2 or more people.
Overt Act
