Definitions and Key Terms
What is the Freedom of Assembly?
It is the fundamental freedom to gather with other people.
What is the Mobility Right?
The ability to leave and enter Canada.
What is Freedom of Expression?
It is essentially the same thing as freedom of speech.
What is the Notwithstanding Clause?
It allows the government to enact legislation in spite of the fact that it may violate those rights and freedomes.
What is the Reasonable Limits Clause?
This is when your rights can be limited within certain situations.
What is Unreasonable Search?
It means that the police can’t look through your stuff just because they feel like it.
What is the Freedom of Association?
It is the fundamental freedom that allows you to participate in groups.
What is the Freedom of the Press?
It is where you can publish what you want.
What is an Analogous Ground?
This is where a particular ground is not listed in section 15(1), the court can decide that the issue is still deserving of protection.
What is Discrimination?
It is treating individuals or groups unfairly or differently because of such characteristics as race, sex, religion, age, etc.
What is Direct Discrimination?
It is based upon a ground that is protected by law.
What is Constructive Discrimination?
It practices that inadvertently exclude certain people, resulting in discrimination.
What is a Stereotype?
It is judging, or forming an opinion of one person of a group and applying that judgement to all members of the group.
What is prejudice?
It is a preconceived opinion of a person based on the person’s belonging to a certain group.
What is Bona Fide?
In Latin, meaning “in good faith”. It means “without the intention to deceive” or “genuine”.
What is Prima Facie?
In Latin, meaning “on its face” or “on the surface”. In a human rights case, this means that the first impression of the case is legally convincing.
What is a Remedy?
It is the way in which a court resolves or fixes a legal problem.
What is a Suffrage?
The right to vote in political elections; franchise.
What is Sexual Harassment?
It is unwelcome actions or conduct of a sexual nature toward another person.
What is Equality Rights?
It is a protection against discrimination based on religion, age, race, etc.
What is a Stay of Proceedings?
It is a court order to stop trial proceedings against an accused person.
What is a Burden of Proof?
It is the responsibility of bringing forth evidence to prove an accused person’s guilt beyond a reasonable doubt.
What is a Read Down?
It is when courts find that a law is generally acceptable, but not in the particular case that is before them.
What is Read In?
Where a court adds something to a statue to make it conform to the Constitution.
What is Entrenchment?
It is when something is established and difficult to change.
What is Infringement?
It is when the government takes an action or passes a law that violates your rights, it is an infringement.
