Lease
contract between owner (lessor) and tenant (lessee). Transfers the lessor’s rights to exclusive possession and use of the property to the tenant for a specified period of time
Lessor’s interest
Called leased fee estate plus reversionary right

Lease-hold Estate
Tenant’s right to possess. Generally considered personal property

Breach of Lease
5 days notice for delinquent rent. If tenant fails to pay the lease is terminated and owner sues for possession
If other than nonpayment of rent, 10 days written notice
Gross Lease
Tenant pays fixed rent
Net Lease
Tenant pays rent plus some of the property charges
Triple-net
Tenant pays rent plus all expenses
Percentage Lease
Fixed rental fee plus percentage of gross income
ex. retail or restaurants
Variable
Allows for changes in charges during the lease period
Ground
Leases unimproved land to tenant who erects building. Usually long term - 50 to 99 years
Remedies - Actual Eviction
in IL called Forcible Entry and Detainer
if tenant does not peaceably vacate, order is delivered to sheriff for forcible eviction
Contructive Eviction
Tenant leaves premises while conditions are uninhabitable because of the landlord’s conscious neglect
Referral Fees
Can receive
- no more than 3 in 12 months
- no more than $1500 or 1 month’s rent whichever is less in 12 months
- just referrals
