custodial sentence
A
- only should be used when offence is so serious and only custody is justified
- many people re-offend and it can break down families through separation

community sentence
A
- MUST CONTAIN PUNISHMENT ELEMENT, Criminal Jstice Act 2003 allowed an order to incorporate unpaid work, drug rehab or curfew requirements
- good at protecting public and acts as a deterrent

A
- most common sentence, makes up for 90% of summary offences and 77% of all offences
- calculated based on income and can reflects both seriousness of offence as well as the ability of offender to pay
- unlikely for violent offences

A
-D is free to go as they have been punished enough

A
-no further action taken unless D reoffends within a set period (up to 3 years)
