What is the goal of the SMART program?
The goal of the SMART program is to safely divert non-violent,
chronic misdemeanor offenders, particularly those who are otherwise resistant to
intervention, to a case manager, individualized treatment and tailored housing placement.
What elements must the offender have to qualify for the SMART program?
Eligible offenders are those who have
been cited or arrested for one or more misdemeanor drug offenses since November,
2014, and have been arrested at least twice in the past six months for a quality of life
offense

It further gives a person
the right to file a written appeal to the agency that entered the data into the system and, if
unsatisfied, they have the right to appeal and file a limited civil suit contesting the decision in
Superior Court. Lastly, AB2298 gives persons the right to file a written inquiry with any law
enforcement agency to determine whether or not their names are included in the CalGang shared
database.

Check the person’s criminal history. If the criminal history reveals at least one
prior case where the person failed to appear within the last 3 years, the officer
shall take the person into custody and book the person into jail. The prior FTA
does not need to be for the same offense.
For domestic violence strangulation cases which form is needed?
BOTH are needed.
The new Strangulation Documentation form is not
domestic violence specific and is to be used whenever strangulation occurs during any criminal
incident. In a domestic violence case where strangulation occurred, both forms are to be used.
