A

What is a Section 59 Police Reform Act warning and what does it allow officers to do?

A

A warning when a vehicle is causing a nuisance (loud, donuts, high revs etc).

Vehicle can be seized if the driver has been warned already and the nuisance continues and he does then continue to do so.

A

Known as a producer.

If someone fails to provide licence or insurance docs and unable to check other means then you can give someone this and they have 7 days to shown at a police station with a help desk.

What is a VDRS?

A

Vehicle Defect Rectification Scheme.

Where there is an issue with the vehicle and you allow them the chance to rectify these issues. They have 14 days to do so and have to have it signed by an MOT garage. They then need to produce this to a police station.

A

Used for offences such as speeding, mobile phone use, seat belts etc.

A

It is an offence to drive, attempt to drive or be in charge of a motor vehicle on a public road after consuming alcohol that exceeds the prescribed limit.

A

What must we tell people before we breathalyse them?

A

I suspect you are driving a motor-vehicle on a road having consumed alcohol so I require you to provide a sample of breath. I have to warn you that failure to provide a sample or refusing to provide may result in your arrest. Testing positive will result in your arrest.

What does Section 6E RTA 1988 allow a Constable to do?

A

Enter ANY place, using reasonable force if necessary, for the purpose of:
- Imposing a requirement for a breath test

  • Arresting someone who has failed a breath test.
  • Arresting someone for failing to comply with a breath test and the Constable has RGB that the suspect has consumed alcohol taking them over the limit and they believe they are the driver. (Only when there has been an accident).
