Title Flashcards
What is good title?
Good title: original owner has good title no matter how many times it has been sold
Ex) The original owner still has good title to something even if it was sold by someone numerous times unlawfully.
What is bad/void title?
Bad title: you don’t have a title. The person who sold it to you didn’t have title and you don’t either.
Voidable title
Seller’s ownership or right to transfer is legally defective or invalid due to certain circumstances. You still have good title even though you sold it.
Ex) selling a phone for $1000. A check is written for it. Later on the check bounces. If a check bounced you haven’t gotten a good title.
What is entrustment title?
If an innocent bonafide purchaser value buys a good from a merchant and didn’t know that it was stolen. The innocent party (BFP) gets to keep it since they bought it in good faith with no notice of the defect.
• only if you buy it from a reputable person
Ex) if you buy a car for $100 then it isn’t entrustment, it is a bad title since it isn’t reasonable
