A person is guilty of theft if s/he:
- dishonestly
- appropriates
- property
- belonging to another

with the

• intention of permanently depriving

the other of it

Appropriation shall NOT be dishonest if:

a) he believed he had a lawful right to take an item
b) he believed the owner would have consented
c) owner couldn’t be found by taking reasonable steps

• fruit

Property includes:

• money
• all other property real or personal including ‘things in action’

property does not include the 5 F’s if wild unless
