Theft Act 1968 Section 1
A person is guilty of theft if s/he:
- dishonestly
- appropriates
- property
- belonging to another
with the
- intention of permanently depriving
the other of it
Appropriates
any assumption by a person of the rights of an owner
something that’s not yours but you’ve decided to treat it as such
Appropriation shall NOT be dishonest if:
a) he believed he had a lawful right to take an item
b) he believed the owner would have consented
c) owner couldn’t be found by taking reasonable steps
Wild 5 F’s:
- fauna
- fungi
- flora
- foliage
- fruit
Property includes:
- money
- all other property real or personal including ‘things in action’
property does not include the 5 F’s if wild unless
- taken for reward or sale or for other commercial use
- reduced into possession by or on behalf of another person
you can pick and pluck but not uproot
property belongs to any person having:
- ownership
- possession or control
- proprietary right or interest
intention to permanently deprive (CARDS)
C onsuming
A bandoning
R etaining
D estroying
S elling
or keeping the property until it is or no further use
