What are the elements of theft by taking?
Dishonestly, Without claim of right, Takes, Any property, With intent to deprive any owner permanently at that property OR with intent to deprive any owner permanently of any interest in that property.
What are the elements of theft by using or dealing?
Dishonestly,
Without claim of right,
Uses or deals with,
Any property,
With intent to deprive any owner permanently of that property OR with intent to deprive any owner permanently of any interest in that property,
After obtaining possession or control of that property in whatever manner.
What does no claim of right mean?
No belief in a right to own or possess the property
Explain what uses/deals in theft mean?
Exceeds the authority or conditions given by using or dealing with the property in any matter
Explain ownership of property?
A person is regarded as the owner of any property that is stolen if the person has
possession or control of the property,
the right to take the possession or control of the property or
any interest in the property.
What is tangible and intangible property?
Tangible = something you can touch. Intangible = something you can’t
Why is knowing the value of an item important when dealing with theft?
It determines the penalty imposed upon conviction.
Summarise the meaning of ownership
If you have;
Possession or control over the property,
Interest in the property,
Or the right to take possession or control over the property (eg part own something)
When is theft complete?
When the offender moves the property or causes it to be moved
