what is standard of proof in civil law
Plaintiff must show that their case/version of the facts is more probable/likely than the defeendants case.
what is burden of proof in civil law
The plaintiff has the bruden of proof in a civil trial. They must prove the defendant has committed a civil wrong The defendant does not have to prove that they did not commit wrong.
What is remedy
If the plaintiff is successful a remedy may be awarded at the end of a civil case. A remedy is a legal process in which people who have been harmed or wronged can seek compensation .
These include- Damages
Court order for specific performances
Aplogy
3 types of damage
specific dmage- Damages that can be accurately assessed eg phsycial injury
General damage- amounts of compemsation that cannot be accuratley measured (suffering)
Ecemplary damage - Awarded where the court intends to make an example of the defendant as a punsihment
