What is GDPR?
General Data Protection Act 2018. It governs the way we can use, process and store personal data about an identifiable person.
What deals with bribery?
The Bribery Act 2010. Policed by the Serious Fraud Office. Maximum penalties are a 10 year prison sentence and/or an unlimited fine.
What deals with discrimination and inequality?
Equality Act 2010. Extends to controllers of let premises.
What deals with sustainability?
Climate Change Act 2008 and the RICS’ commitment to sustainability and best practice.
When is an EPC required (5)?
- Commercial buildings over 50m2. 2. Newly built, let or sold for more than 6 months. 3. When heating/ventilation/air-con is refurbished. 4. All existing leases from 01/04/23. 5. When a lease is assigned/sub-let.
What buildings are exempt from requiring an EPC (6)?
- Listed buildings. 2. Have no heating. 3. Religious buildings. 4. Temporary buildings. 5. Are due to be demolished. 6. Resi not occupied for more than 4 months of the year.
How long does an EPC last?
Valid for 10 years unless altered.
What is the penalty for not having an EPC?
12.5% of the RV.
What is MEES?
Minimum Energy Efficiency Standards 2015.
What does MEES mean for a property?
A minimum EPC rating of E to let a building from 01/04/18 onwards. Applies to all existing leases from 01/04/23.
What are the potential changes to MEES?
Potentially rising the minimum EPC rating to C by 2027 and B by 2030. All properties will require one including Listed Buildings.
What are Green Lease Clauses?
They ensure landlord & tenants share information about the use of energy, water & waste arising in a building.
What is HSE?
The Health & Safety Executive. It’s the national regulator for workplace health & safety preventing work-related death, injury and ill health.
What legislation is in place for H&S?
The Health & Safety at Work Act 1974.
