Describe s49.
s49 is reasonable care and skill where the trader must perform the service with reasonable care and skill - The standard of care is equivalent to that of the ‘reasonable man’ which is the ‘ordinary person performing the particular task’. (Thake v Maurice (1986)).
Describe s52.
s52 is performance within a reasonable time.
- Applies where the contact does not have a term with respect to time and the service has taken longer than expected or not been completed.
- ‘Reasonable time’ depends on the circumstances.
