What are the terms implied into a contract to supply goods? (Section numbers and descriptions).
s9 - The right to satisfactory quality.
s10 - The right of fitness for particular purpose.
s11 - The right relating to description.
Describe s9:
Section 9 – Satisfactory quality.
- Based on the view of the ‘reasonable man’.
- Quality includes fitness for purpose, appearance and finish, freedom from minor defects, safety of the goods.
Describe s10:
Section 10 –Reasonable fitness for particular purpose.
- If C makes the purpose for which the goods are o be used clear to T, then they must be fit for that purpose.
Describe s11:
Section 11 - Relating to description:
- If supply of goods is by reference to a particular model seen or examined by C then goods must match the model.
What is a trader?
Trader is defined in S 2 as “a person acting for purposes relating to that persons trade, business, craft or profession..”
What is a consumer?
Consumer is defined in S 2 as “an individual acting for purposes that are wholly or mainly outside that individuals trade, business, craft or profession”.
